TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the Nanotechnology World website and platform (the “Platform”), operated by Nanotechnology World Association Inc. (“Nanotechnology World,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

If you are using the Platform on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use your information.

Nanotechnology World is a business-to-business (B2B) directory and information platform for the nanotechnology industry. The Platform allows registered suppliers, organizations, and individuals to create listings, publish company or product information, and access subscription-based content and features.

Nanotechnology World does not process, facilitate, or take part in any transaction, purchase, sale, negotiation, or contract between users of the Platform. We provide a directory and information service only. Any business dealings between users occur entirely outside the Platform and are solely between those parties.

The Platform is intended for business use. You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Platform.

By using the Platform, you confirm that you are acting for purposes relating to your trade, business, or profession, and not as a consumer.

• You must provide accurate, current, and complete information when creating an account, and keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us promptly at info@nanotechnologyworld.org if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

• Certain features of the Platform require a paid subscription. Pricing, billing frequency, and features included are described at the time of purchase.
• Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
• Fees are billed in advance on a recurring basis unless otherwise stated, and are non-refundable except as required by law.
• You authorize us (or our third-party payment processor) to charge your chosen payment method for all applicable fees.
• We may change subscription pricing with prior notice. Continued use of the Platform after a price change takes effect constitutes acceptance of the new pricing.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period unless stated otherwise.

You agree not to:

• Post false, misleading, or fraudulent information in any listing or profile;
• Use the Platform to harass, defame, or infringe the rights of others;
• Scrape, data-mine, or use automated means to extract data from the Platform without our written permission;
• Upload malicious code or attempt to compromise the security or integrity of the Platform;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use the Platform for any unlawful purpose or in violation of applicable export control, trade sanctions, or industry-specific regulations.

We reserve the right to remove content or suspend accounts that violate this section, at our discretion.

• You retain ownership of the content you submit (e.g., company profiles, product listings, articles) (“User Content”).
• By posting User Content, you grant Nanotechnology World a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as part of operating the Platform.
• You represent that you own or have the necessary rights to the User Content you submit, and that it does not infringe any third party’s intellectual property or other rights.
• Disclaimer: Nanotechnology World does not verify, endorse, or guarantee the accuracy, quality, or legitimacy of any listing, claim, certification, or representation made by suppliers or other users. Users engaging with listed suppliers do so at their own risk and are responsible for their own due diligence.

All Platform design, branding, text, graphics, logos, and software (excluding User Content) are the property of Nanotechnology World or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Platform without our prior written consent.

The Platform may contain links to third-party websites or services we do not control. We are not responsible for the content, accuracy, or practices of any third-party site, and inclusion of a link does not imply endorsement.

The Platform is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Nanotechnology World and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of or inability to use the Platform — including any dealings you have with other users or suppliers found through the Platform.

Our total aggregate liability for any claim arising out of these Terms or your use of the Platform will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD 100).

You agree to indemnify and hold harmless Nanotechnology World from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your User Content, or your violation of these Terms.

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Platform and close your account at any time.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless otherwise required by mandatory local consumer protection law in your place of residence.

We may update these Terms from time to time. We will notify you of material changes through the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

• Severability: if any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
• Survival: Sections 7 (User Content and Listings), 8 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law and Dispute Resolution) continue to apply after your account is closed or terminated.
• No waiver: our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
• Entire agreement: these Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Platform.
